TERMS OF USE

OE-INDEPTH (the "Site" or “INDEPTH”) provides online educational services that include courses and modules intended to offer a deeper look at various aspects of the life and work of Ostad Elahi. These Terms of Use are an agreement between you and the Site; they set forth the conditions for your use of this Site, including its Privacy Policy, and all information on or submitted through this Site.

Your use of this Site, or your provision to us of any content or information, constitutes your agreement to these Terms of Use and any other terms and conditions that may be outlined elsewhere on this Site, including but not limited to our Privacy Policy.  If you do not agree to comply with these Terms of Use in their entirety, or your jurisdiction will not honor the terms of this Site, you are not authorized to use this Site, and you may not access or link to this Site or download any materials or content from this Site.  We reserve the right to modify these Terms of Use at any time without notice. You acknowledge and agree that you are responsible for keeping yourself apprised of any such changes.

Restrictions on Use of Content; Copyright
INDEPTH is owned, operated, and maintained by the Nour Foundation. Unless otherwise noted, all materials on this Site are provided for non-commercial use only and are protected as the copyrights, trade dress and trademarks and/or other intellectual properties owned by the Nour Foundation, and/or its grantees or affiliates or by other parties that have licensed their material to us. We expressly reserve all rights to this Site and our materials under U.S. and international laws. The materials contained in this Site may not be modified or altered in any way. You may not copy or distribute any photograph, illustration, artwork, video, or other graphic material contained on this Site for any use unless explicit permission to do so is granted on the materials themselves or on the web page containing the materials. Except as noted above, you may not copy, distribute, enter into a database, display, perform, create derivative works of, transmit, or in any way exploit any part of our Site, including computer programs and other coding.

Trademarks
You acknowledge and agree that the OE-INDEPTH name, logo and other Nour Foundation trademarks and service marks ("Our Marks") are trademarks of the Nour Foundation in the United States and other countries. You may not use Our Marks for any product or service that does not belong to us, nor in any manner that is likely to cause confusion about whether we are the source, affiliated with, sponsor of, or endorser of any product or service. In addition, you may not use Our Marks in any manner that disparages or discredits us.

Registration and User Profiles
All information collected on this Site is subject to our Privacy Policy. Some areas of the Site may require you to select a temporary alias and/or to register or create a user profile as part of a registration process. Completion of the process usually involves creating an account with a username or identifier and password, which you agree to guard as confidential information and take all reasonable measures to keep secure.  You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Site or portions of it using your username, password, or other security information. You agree to provide accurate, current and complete registration information at all times, and to update it in a timely manner. In addition to exercising all rights and remedies allowed by law, we have the right to suspend or terminate your access, registration, or participation in our modules, courses, and programs at any time and for any or no reason, including any violation, in our opinion, of any provision(s) of these Terms of Use.

You agree that all uses of the alias or identifier associated with your account (whether selected by you or provided by us) will be attributed to and legally bind you and may be relied upon by us and our agents, affiliates, and other third parties with whom we work, including but not limited to our and their respective affiliates, current and former trustees, officers, staff and agents (collectively “Third Parties”), as being a use made by you, even if someone else uses your identifier.

User Conduct
You are responsible for reading or viewing any administrative or instructional documents or videos that are posted on the course pages prior to the scheduled sessions to stay abreast of any updates, announcements, or schedule changes.

You cannot impersonate others or provide inaccurate information during the registration process. Although participation in a course is based upon the selection of an alias, you must provide accurate and up to date information during the registration process, which may include providing personal data.

By registering for a course, you represent that you are able to sufficiently speak, read, and write the language in which the course is offered. The minimum age for registration in any INDEPTH module or course is 15.

Links, Frames and Metatags
You may link to the home page of our Site as long as the link does not cast us in a false or misleading light. INDEPTH prefers advance notice of such linking, which can be sent to support@oe-indepth.com. You may not frame the content of our Site. You may not use metatags or any other "hidden text" that incorporates Our Trademarks or our name without our prior express written consent.

Disclaimer of Warranties and Limitation of Liability
INDEPTH DOES NOT CONFER DEGREES OR CERTIFICATES OF ANY KIND, NOR DOES IT PROVIDE DIRECT ACCESS TO ITS AUTHORS, CONTRIBUTORS, OR PRESENTERS. Note to Users Outside of the United States
This Site is controlled by us from offices in the United States of America. If you choose to access this Site from locations outside the U.S., you do so at your own risk and you are responsible for compliance with any local laws. You may not use or export anything from the Site in violation of U.S. export laws, regulations, or these Terms of Use.

Termination
We reserve the right to terminate the Site and these Terms of Use at any time, without notice, for any reason including, in the case of the Terms of Use, for your violation of any of its provisions. INDEPTH reserves the absolute right to refuse any user to register, and/or to ban any user from further participation in any INDEPTH course or program based upon misconduct, abuse, or disruptive behavior, at its sole discretion. The Disclaimer of Warranties, Limitation of Liability, Release and Indemnity and Governing Law Sections of these Terms of Use shall survive any such termination.

Governing Law
These Terms of Use will be governed by the laws of the State of New York applicable to contracts made and performed there without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts sitting in the State and County of New York and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

Entire Agreement
These Terms of Use, including the Privacy Policy, are the entire agreement between you and us and supersede any prior understandings (oral or written).

We may change or update these Terms of Use, and as such encourage you to refer back to it periodically.

We are committed to protecting your privacy. This Privacy Policy is part of our Terms of Use and is designed to help you understand how OE-INDEPTH (this “Site” or “INDEPTH”) collects personally identifying information about you and how it uses and discloses that information. This Privacy Policy applies to data that personally identifies you, other than publicly available information (“personal information”) that is collected on this Site. Your use of this Site constitutes your agreement to this Privacy Policy.

We have developed our Site so that you may visit it without identifying yourself or revealing any personal information. We collect personally identifying data about you, such as your name, address and e-mail address, only when you provide it to us voluntarily; we do not require you to register or provide personal information to us in order to view our Site. Data Storage Location and Duration
Our databases are located in the United States. If you are located outside of the US, by sending us your data you consent to its transfer to and storage within the US. We keep data you provide to us for as long as we think is necessary or advisable and reserve the right to retain it to the full extent not prohibited by law. We may discard any data you provide to us at our discretion and you should not rely upon our storage of any personal information or other data.

Information You Provide About Others
Do not provide or allow others to provide personal information about anyone unless you, on your own behalf and on behalf of anyone whose information you provide: (a) have reviewed and agree with this Privacy Policy, and (b) are authorized to and do consent to have all data used and transferred internationally. By submitting any personal information about others, you represent and warrant that you received such authorization beforehand.

Non-Personal Information and Data
Non-personal information and data may be collected on the Site through tracking mechanisms such as “cookies” that recognize repeat visitors, facilitate your ongoing access to and use of the site, and allow us to track usage behavior and compile aggregated data that will allow content improvements. You may elect to block cookies through your browser settings. However, if you block cookies you may not have access to some of the Site’s services and features. We use tracking mechanisms only to obtain non-personal information in order to improve visitors’ online experience and facilitate your visit within our site.

Children 13 Years Old and Under
Our Site is not specifically dedicated to children and we do not actively solicit information from children. Children under the age of 13 are required to obtain permission from a parent or guardian prior to providing any personal information. If we become aware that we have inadvertently collected “personal information” (as defined by the United States Children’s Online Privacy Protection Act) from children under the age of 13 without valid parental consent, we will take reasonable steps to delete it as soon as possible. We do not knowingly process data of EU residents under the age of 16 without parental consent. If we become aware that we have collected data from an EU resident under the age of 16 without parental consent, we will take reasonable steps to delete it as soon as possible. We also comply with other age restrictions and requirements in accordance with applicable local laws.
